TTapObserves Terms of Service

These Terms of Service govern access to and use of TTapObserves, a creator-content production, management, and publishing technology service operated by Quality Care Preference LLC (“QCP,” “TTapObserves,” “we,” “us,” or “our”).

By accessing or using TTapObserves, connecting a social-media account, uploading content, or authorizing TTapObserves to perform supported publishing functions, you agree to these Terms.

1. TTapObserves

TTapObserves is a technology and media platform designed to assist authorized creators with preparing, organizing, reviewing, managing, and publishing original short-form, serialized, commercial, educational, and other digital content.

Features may include content-development tools, story and project management, video preparation, scheduling support, creator-authorized social-media publishing, product-content organization, analytics, and other creator tools made available from time to time.

TTapObserves is being developed as a commercial technology product owned and operated by Quality Care Preference LLC.

2. Separate Clinical Services

Quality Care Preference LLC also provides behavioral-health and clinical services separate from TTapObserves.

Use of TTapObserves does not establish a therapist-client, counselor-client, patient-provider, supervisory, or other clinical treatment relationship with Quality Care Preference LLC or any clinician affiliated with QCP.

Clinical services are subject to separate intake requirements, informed-consent documents, service agreements, privacy notices, patient-rights requirements, professional standards, and applicable federal and state healthcare laws.

Information submitted through TTapObserves should not be used to seek emergency, medical, psychiatric, substance-use, or other clinical care.

3. Eligibility

You must be legally capable of agreeing to these Terms and meet the age and eligibility requirements of any third-party platform you connect to TTapObserves.

Unless expressly stated otherwise for a particular service, TTapObserves is intended for adults age 18 and older.

4. Connected Accounts

TTapObserves may allow a user to connect an account maintained by TikTok or another third-party service.

You remain the owner and controller of your third-party account.

TTapObserves will not request that you provide your TikTok password directly to TTapObserves when an authorized platform authentication method is available. Account connection should occur through the applicable provider’s authorized authentication process.

You authorize TTapObserves to perform only those account functions for which you grant permission.

You may revoke applicable permissions through the connected platform or another method we make available.

5. TikTok and Other Platform Rules

Use of TTapObserves does not replace your obligation to comply with TikTok Community Guidelines, TikTok Shop requirements, commercial-content disclosure requirements, intellectual-property rules, developer requirements, or the policies of any other connected service.

Platform approval, continued API access, content distribution, account eligibility, monetization, reach, sales, views, followers, or other performance outcomes are controlled in whole or in part by third parties and are not guaranteed by TTapObserves.

6. Creator Control

TTapObserves is designed to preserve creator authorization over connected-account actions.

Where platform requirements call for creator review, confirmation, disclosure selection, privacy selection, or other affirmative action, users remain responsible for completing those actions.

Users are responsible for reviewing content before public publication.

7. User Content

You retain ownership of original content you submit to TTapObserves, subject to the rights of any third party whose material may appear in that content.

You grant Quality Care Preference LLC a limited license to host, process, transform, transmit, format, store, and otherwise use submitted content only as reasonably necessary to provide TTapObserves services and perform actions you request.

TTapObserves does not acquire ownership of your original creative work merely because it is processed through the service.

8. TTapObserves Intellectual Property

TTapObserves software, workflows, interfaces, databases, automation architecture, proprietary templates, branding, documentation, original system components, and other intellectual property owned by Quality Care Preference LLC remain the property of QCP or its applicable licensors.

These Terms do not transfer ownership of TTapObserves technology to users.

9. Artificial Intelligence and Automated Tools

Some TTapObserves functions may use artificial intelligence, automation, rules-based systems, or computer-generated media.

Automated output may contain errors, inaccuracies, continuity problems, inappropriate material, or information requiring human review.

Users remain responsible for reviewing content before publication and for making disclosures required by TikTok or another applicable platform regarding AI-generated or substantially modified content.

TTapObserves may implement automated safeguards designed to prevent publication when specified validation checks fail.

10. Prohibited Uses

TTapObserves may not be used to publish unlawful material; infringe intellectual-property, privacy, publicity, or other rights; impersonate another person deceptively; distribute malicious software; interfere with platform security; evade platform restrictions; automate prohibited spam; conduct unauthorized surveillance; exploit minors; facilitate fraud; or perform actions prohibited by applicable platform policies or law.

QCP may suspend access when reasonably necessary to protect users, connected platforms, QCP, or the public.

11. Commercial and Affiliate Content

TTapObserves may support creator commerce, affiliate marketing, sponsored content, product placement, or other commercial activity.

Users remain responsible for making legally required advertising and material-connection disclosures and for complying with applicable platform commerce requirements.

TTapObserves does not guarantee affiliate approval, commission payments, product availability, conversion rates, or sales.

12. Fees and Future Commercial Services

Certain TTapObserves services may be offered without charge, while future features may be offered on a paid basis.

No user will be charged for a paid service unless applicable pricing and payment terms are presented before purchase or authorization.

13. Privacy

Use of TTapObserves is also governed by the TTapObserves Privacy Policy.

Clinical protected health information is governed separately by Quality Care Preference LLC’s applicable healthcare privacy notices and laws.

14. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the information and functions maintained by TTapObserves.

No internet-connected system can be guaranteed to be completely secure or continuously available.

Users are responsible for securing their own devices, accounts, credentials, and recovery methods.

15. Availability and Changes

Features may change as third-party APIs, laws, platform rules, technical requirements, or business needs change.

TTapObserves may modify or discontinue functionality when necessary.

We do not guarantee uninterrupted availability.

16. No Guarantee of Monetization or Distribution

TTapObserves does not guarantee TikTok Creator Rewards eligibility, TikTok Shop revenue, social-media monetization, viral distribution, follower growth, engagement, sales, sponsorships, or any particular business result.

17. Limitation of Liability

To the extent permitted by applicable law, Quality Care Preference LLC will not be responsible for indirect, incidental, special, consequential, or punitive damages arising solely from use or inability to use TTapObserves, including loss associated with platform outages, platform enforcement actions, third-party policy changes, interrupted API access, or user publication decisions.

Nothing in these Terms excludes liability that cannot legally be excluded.

18. Termination

You may stop using TTapObserves and revoke applicable connected-account permissions.

QCP may restrict or terminate access for material violations of these Terms, applicable law, security requirements, or third-party platform policies.

19. Governing Law

These Terms are governed by applicable federal law and the laws of the State of Wisconsin, without overriding any consumer right that applicable law does not permit a contract to waive.

20. Changes to These Terms

We may revise these Terms as TTapObserves changes. The current version will identify its effective date and will be posted on this website.
